NETVEXA Ltd provides these integrations for convenience, functionality, and performance purposes only. While we strive to ensure reliability and security, NETVEXA Ltd does not guarantee the performance, availability, security, or suitability of any third-party or open-source components included in our solutions.

Users remain responsible for complying with the terms and licenses of all third-party or open-source software included in NETVEXA LOCAL and NETVEXA GLOBAL.

Limitation of Liability: NETVEXA Ltd shall not be liable for any issues, malfunctions, vulnerabilities, breaches, or damages arising directly or indirectly from the use of third-party or open-source software. This includes, but is not limited to, security vulnerabilities, data loss, interruptions, or unauthorized access caused by such components. Users acknowledge that using third-party or open-source elements carries inherent risks beyond the control of NETVEXA Ltd.

NETVEXA GLOBAL Traffic Limit: NETVEXA GLOBAL is capped at 29.95TB of data traffic per calendar month. Once this limit is reached, services will be automatically paused until the monthly traffic allowance is refreshed. Additional traffic capacity is not included unless specifically purchased under a separate agreement.

3.4 Service Availability

We strive to provide 99.9% uptime for NETVEXA LOCAL and NETVEXA GLOBAL, but we do not guarantee uninterrupted service. Scheduled maintenance and unforeseen outages may occur.

3.5 Subscription & Billing

By subscribing to NETVEXA LOCAL or NETVEXA GLOBAL, you agree to the payment terms presented at checkout. Subscription fees are billed in advance and are non-refundable unless otherwise stated in these Terms.

Discounts & Promotions: From time to time, NETVEXA Ltd may offer limited-time discounts, promotions, or special pricing. These offers are subject to change or cancellation at any time and may be restricted by eligibility criteria, such as new customers only or specific subscription durations. Discounted prices apply only for the duration specified and revert to standard pricing thereafter, unless stated otherwise.

Please note that discounted offers (e.g., a reduced rate for a 12-month subscription) apply only to the initial purchase term. Renewal rates are not guaranteed to match the original discounted price and will be charged at the then-current standard rate, unless another valid promotion is applied at the time of renewal.

3.5.1 Service Delivery

We aim to deliver NETVEXA GLOBAL services (including provision of your admin connection profile and activation of your subscription) within 24 hours of purchase. If there are further delays, we will contact you directly to provide an update.

3.5.2 Cooling-Off Period & Cancellation Rights

Under UK consumer law, you have the right to cancel your subscription within 14 days of purchase (the "Cooling-Off Period"). By placing an order, you acknowledge and agree that:

3.7 Disclosure to Authorities

NETVEXA Ltd may be legally required to disclose certain information to law enforcement or regulatory authorities under applicable UK laws, including but not limited to the Investigatory Powers Act 2016, the Data Protection Act 2018, and the Regulation of Investigatory Powers Act 2000.

While we respect user privacy and do not monitor browsing activity, we may provide connection metadata or account information to competent authorities where required by law or pursuant to a valid legal request, warrant, or court order.

3.8 Connectivity Speeds & Performance

While NETVEXA Ltd strives to provide reliable and fast network connections through NETVEXA LOCAL and NETVEXA GLOBAL, we do not guarantee specific connectivity speeds or latency levels. Actual performance may vary due to factors outside our control, including but not limited to:

3.9 Administrator Responsibility (NETVEXA GLOBAL)

The Administrator is defined as the individual who signs up for and holds the NETVEXA GLOBAL hub account. As the Administrator, you are responsible for:

3.10 Access Control & Security Measures

NETVEXA Ltd reserves the right to block or restrict access to certain websites, IP addresses, or applications. Availability may vary, and a service that works at one time may not be accessible at a later time. These changes may occur without prior notice and will not result in refunds.

Additionally, NETVEXA Ltd actively blocks known malicious IP addresses from connecting to NETVEXA LOCAL and NETVEXA GLOBAL hubs to ensure the security and integrity of our network and services.

3.11 Device-to-Device Security Disclaimer

NETVEXA LOCAL and NETVEXA GLOBAL do not provide protection against device-to-device attacks or infections within the same hub. Admins are solely responsible for ensuring that only trusted devices are connected to a single hub. NETVEXA Ltd is not liable for any security issues, malware, or unauthorized access resulting from connections between devices under a single hub account. Proper endpoint security, including antivirus software and firewalls, should be maintained on all connected devices.

4. No Warranties & Limited Liability

NETVEXA LOCAL and NETVEXA GLOBAL are provided on an **"as-is" and "as-available"** basis. NETVEXA Ltd makes no guarantees regarding uptime, speed, or security. To the maximum extent permitted by law, NETVEXA Ltd shall not be liable for any damages arising from service use, including but not limited to:

5. Service Suspension & Termination

Service Pauses: In cases where NETVEXA GLOBAL traffic limits (29.95TB/month) are exceeded, services will be paused until the monthly limit is refreshed. Such pauses are not considered a breach or termination of service, and no compensation or refund will be provided for downtime caused by exceeding traffic caps.

6. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

7. Changes to Terms

NETVEXA Ltd reserves the right to update these Terms at any time. Continued use of our services after changes means you accept the revised Terms.
